These Terms of Use (“Terms”) are an agreement between you and EPITOME MEDIA LLC (“EPITOME MEDIA”, “we”, “us”) and govern your use of the IQ style mobile applications, the website iqstyle.app and related services (together, the “Service”). By using the Service, you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 18 years old and able to enter into a binding contract to use the Service. You may not use the Service if you are barred from doing so under applicable law, including export control and sanctions laws.

2. The Service

IQ style is a personal styling assistant powered by artificial intelligence. It can analyze photos you choose to share, help you organize your wardrobe, suggest outfits, give opinions on possible purchases and create preview images. The Service provides general style advice for personal use. It is not medical, dermatological or other professional advice. Features may change over time, and some may be available only in certain countries or on certain devices.

3. Your account

Please give accurate information when you create an account and keep your sign-in details secure. Your account is for you alone. You are responsible for activity under your account, and you should tell us promptly at support@iqstyle.app if you believe it has been accessed without permission. You can delete your account at any time in the app or by contacting us.

4. Subscriptions and payment

Some features require a paid subscription. The price, billing period and any free trial are shown before you confirm a purchase.

• Purchases through the App Store or Google Play are processed by Apple or Google and charged to your Apple Account or Google account. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel a subscription in your App Store or Google Play account settings. Refund requests for these purchases are handled by Apple or Google under their policies.
• Free trials convert to a paid subscription at the end of the trial unless you cancel before it ends. Where the store applies this rule, any unused part of a trial ends when you buy a subscription.
• Purchases directly from us, if we offer them, show the price, renewal terms and cancellation method before you pay, and can be cancelled online at any time.
• Price changes are announced in advance as required by law and by the store you purchased from.

If you are a consumer in the European Union or the United Kingdom and buy a subscription directly from us, you have a 14-day right of withdrawal. If you ask us to start the Service during that period, you agree to pay for the part of the Service provided before you withdraw.

5. Your content

You keep ownership of the photos, messages and other content you submit (“Your Content”). You give EPITOME MEDIA a worldwide, non-exclusive, royalty-free license to host, store, process, adapt and display Your Content only as needed to operate, secure and improve the Service for you — for example, to analyze a portrait, tidy up a photo of a garment or create a preview of an outfit on your photo. This license ends when Your Content is deleted from the Service, except for copies we must keep by law.

You confirm that you have the rights needed to share Your Content and that any adult shown in your photos has agreed to it.

6. Acceptable use

When using the Service, you agree not to:

• upload photos of children, or of other people without their permission;
• upload or try to generate nude, sexual or intimate images;
• use the Service to create misleading images of real people, to impersonate anyone, or to harass, threaten or harm others;
• break the law or infringe anyone’s rights;
• copy, scrape, reverse engineer or disrupt the Service, or bypass its security or usage limits;
• resell or commercially exploit the Service without our written permission.

7. AI output

Advice, text and images produced by the Service are generated by AI and may be inaccurate, incomplete or not suited to your situation. Preview images are illustrations and may not show exactly how an item fits or looks in real life. Use your own judgment before acting on any suggestion, including before buying anything. Images created by the Service are labeled as AI-generated; do not remove that label or present such images as real photographs.

8. Shopping and third parties

The Service may show products and link to third-party stores. We do not sell those products and are not responsible for third-party websites, products, prices, delivery or returns, which are governed by the third party’s terms. We may receive a commission when you buy through some links; this does not change the price you pay.

9. Our intellectual property

The Service, including its software, design, text, the IQ style name and logo, and the styling methodology it applies, is owned by EPITOME MEDIA or its licensors and is protected by law. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial purposes in line with these Terms. If you send us feedback or ideas, we may use them without any obligation to you.

10. Suspension and termination

You can stop using the Service and delete your account at any time. We may suspend or end your access if you seriously or repeatedly break these Terms, if required by law, or to protect users or the Service. Where reasonable, we will tell you why and give you a chance to respond. Deleting your account does not by itself cancel a subscription bought through Apple or Google; please cancel it in your store settings.

11. Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free or that its suggestions will meet your expectations. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

12. Limitation of liability

To the extent permitted by law, EPITOME MEDIA will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid for the Service in the 12 months before the claim arose and US $50. These limits do not apply where the law does not allow them, including liability for death or personal injury caused by negligence, or for fraud.

13. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Florida, unless the law of your country gives you the right to bring a claim in your local courts. If you are a consumer in the European Union or the United Kingdom, you also keep the protection of the mandatory laws of your country of residence.

14. App Store terms

If you downloaded the IQ style app from Apple’s App Store, the following also applies:

• These Terms are between you and EPITOME MEDIA only, not Apple. EPITOME MEDIA, not Apple, is solely responsible for the app and its content.
• Your license to use the app is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to provide maintenance or support services for the app.
• If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
• Apple is not responsible for addressing any claims by you or a third party relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and claims under consumer protection, privacy or similar laws.
• If a third party claims that the app or your use of it infringes their intellectual property rights, EPITOME MEDIA, not Apple, is responsible for the investigation, defense, settlement and discharge of that claim.
• You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
• You must comply with any applicable third-party terms when using the app.
• Apple and its subsidiaries are third-party beneficiaries of these Terms, and Apple has the right to enforce them against you as a third-party beneficiary.

15. Changes

We may update these Terms as the Service evolves or the law changes. We will post the updated Terms on this page and change the effective date. If a change materially affects your rights, we will tell you in the app or by email before it takes effect. If you do not agree to the updated Terms, you can stop using the Service and delete your account.
